Constructive Dismissal
An employee may resign involuntarily as a result of the workplace environment in the following instances:
 
Employer Prejudice

Where the employer has for personal reasons desires to dismiss the employee but do not have good grounds to do so, nonetheless, deliberately sets out whether openly or covertly in a manner which leaves the employee with little or no choice but to resign in order to avoid working in an unpleasant or unsafe workplace. Here the employer is really hoping that the employee will resign on the employee's own accord.

Often the employer will change the job description without the consent of the employee resulting either in a demotion or the employee having to assume unpleasant tasks. In other cases the employer subjects the employee to continual verbal abuse or unpleasant manners.

Where the employer has for no good reason failed to rectify an unsafe workplace or machinery despite repeated request by the employee.

Where the employer has for no good reason failed to act on complains of continual misconduct of other employees towards the employee.
